Memorandum of
Association
1. The name of the society shall be “NADIA DISTRICT YADAV SABHA’’
2.The
registered office of the society shall be at KRISHNAGAR.

3.Aims
and objectives of the society :-Sec.4(2) of WBSR Act 1961
(a) To generate and foster fraternal
unity among Yadavs.
(b) To remove illiteracy and spread
education in the community by instituting scholarship and stipends to deserving
and meritorious students. To establish schools, college and institutions as
well as residential hostels.
(c) To eradicate social evils, bad
customs and practices. To prevent wasteful expenditure of money by inculcating
habits of thrift.
(d) To improved social affinity in the
community by encouraging inter – state marriages and to arrange mass marriages.
(e) To inculcate social, moral, cultural
values among the Yadav by every conceivable method.
(f) To arrange lectures, demonstrations,
exhibitions and seminars for the benefit of the community.
(g) To improve the social and economic
conditions of the community.
(h) To Promote and encourage the spirit
of self and mutual help, co-operation and good relations with neighbours and to
create awareness in the community to actively participate in activities that
uplift the community.
(i) To devise ways and means to help
Yadavs to achieve ancestral glory and to foster and propagate the teachings of Shrimadbhagvadgeeta .
(j) To take up development works in rural
areas, construction of roads, buildings irrigation projects etc.
(k) To
distribute “Yadav Keshari”the journal
published by the “Bangiya Yadav Mahasabha” among the
Yadavs in the district Nadia.
(l) The Management & Control of
“Nadia District Yadav Sabha” shall be in the hands of a committee of management
of the society elected for two years by
the bonafied members of the “Nadia District Yadav Sabha ” & shall be
carried on in accordance with the rules as may be framed or modified from time
to time by the said committee of management with prior permission of “Bangiya Yadav Mahasabha”.
(m)To keep society
absolutely Apolitical (i.e.,politically neutral) and
secular identity.

3.Preliminary:
Unless there is anything repugnant in the subject or context:
(a) (1) “Mahasabha” means “BANGIYA YADAV
MAHASABHA’’ which is the predecessor of Bangiya Gope
Samity which was established in 1922 & affiliated to the All India Yadav
Mahasabha (Akhil Bharatbarshiya Yadav Mahasabha) and
act as state branch of all India Yadav Mahasabha since 1924.
(2) Sabha means All the
Branch/unit at the district /Thana/Block/Municipality/Anchal/Village/Ward level
organization.
(3) As per 3. (a) (2) Nadia District
Yadav Sabha is a District Branch of Bangiya Yadav
Mahasabha and it will have constitution of his own without any conflict with
the Constitution of Bangiya Yadav Mahasabha.
(b) “Rules’’ means the rules
embodied in this Constitution and include all such amendments made from time to time in
accordance with the prescribed procedure.
(c) “Committee” means a body of person appointed
to investigate, examine and report on any question or business referred to it,
by the Nadia District President or its Executive Committee.
(d) “Member” means and included
a person admitted to membership in accordance with the rules.
(e) “Office Bearers” include the President, Vice
President, Secretary and other
Assistant Secretaries as well as the
Treasurer and assistant Treasurer.
(f)
“President” means a person elected under the rules to perform the duties of the
President.
(g)”Secretary ” means a person nominated to perform such
duties as assigned to him by the President and approved by the Executive
Committee.
(h)
“Vice-President “ means a a person nominated to
perform such duties as assigned to him by the President and approved by the
Executive Committee .
(i) “Assitant Secretaries’’ means person nominated by the
President to perform duties assigned to them.
(j)
“Treasurer” means a person nominated to perform the duties of a treasurer under
the supervision of the President.
(k) “Other
Office Bearers’’- President may appoint according to necessity.
(l)
“Auditor’’ means a person appointed to perform the duties of audit.
(m) “Year’’
means the English calendar year
from 1st January to 31st
December for primary member and the financial year will be started from 1st
April and will be ended next year 31st March.
(n)
“Delegates” means such person/persons as described in Article 12(ii).
(o) “Fund’’/
“Trust”- means “Fund(s)” / “Trust(s)” constituted by the Mahasabha President or
its Executive Committee or District President of Nadiya District Yadav Sabha
from time to time for specific purpose.
(p) BYM EC
Member- required number of members will be selected by the President of Nadia
District Yadav Sabha(NDYS-short form of
Nadia District Yadav Sabha) in
consultation with the State President of
BYM(Short form of Bangiya Yadav Mahasabha) from the
panel prepared by the District Council
of NDYS.
4. Membership:
(i).Admission:
The
Signatories to the Memorandum of Association and the office bearers of the
Governing Body of this Association shall be the first members of the Society
.The Governing Body may admit to membership any person of any caste declared as
Yadav of any sex who has attained the age of 18 (eighteen) years and agreed in
writing to be bound by the society and who in the opinion of the Governing Body
will be interested in advancement of the objects of the society.
Be it noted here
that the power to admit the members is the sole and absolute power of the
Executive committee of Nadia District Yadav Sabha
May refuse
to admit any person as a member without assigning any reason therefore.
(ii) Types of Members:
1.Primary Members:
a) Any person of 18 years of age or
above who belongs to the Yadav community can become a primary member of the
Yadav Mahasabha.
(b) No
person shall be eligible to become a primary member except at his permanent
place of residence or at a place where he carries on his business or profession
or work.
(c) The term
of primary membership shall be up to 31st December of the year of
his/her enrolment.
(d)
Permanent register of primary members of a primary unit shall be maintained by
the Unit. It shall contain serially the full name, address, age, occupation,
and date of enrolment of each member.
(e) Renewal
of primary membership can be made by depositing the requisite membership fee
before expiry of the membership term.
(f) The
annual subscriptions paid by primary members shall be distributed in the
following proportions amongst the respective units.
(i) State
Unit 40%; (ii) District Unit 20% (iii) Block Unit 20% ; (iv) Primary Unit 20%
2.LIFE MEMBERS:
(a)Any person of 18 yrs. Or above who belongs
to the Yadav community on payment of Rs.
500/- or such amount as may be fixed by the executive Committee of the Bangiya Yadav Mahasabha from time to time can become a life
member. An identity card will be issued to such life member through the
District committee after registering his /her membership number and relevant
data in the Register.
(b) To be
the nominated or elected member or office bearer of any committee (District
,Block/Thana/Village/Town/ward committee) he or she must take the Life
membership as per Bangiya Yadav Mahasabha Guideline.
(iii) Cessation of Membership:
Any member
shall cease to be a member
(a) On the acceptance of his /her
resignation from membership,
(b)on his /her becoming insane or insolvent,
(c)on his /her conviction of any offence in connection with
the formation promotion, management or conduct of affairs of society or a body
corporate or any offence involving moral turpitude.
(d) For Any criminal activity of a member for which Executive
committee after enquiry by the Committee formed as per decision of the District
Council for that allegation raised by any one in writing seems fit for
exclusion of membership.
(iv) Register of
Members:
The Society shall maintain different register of Members for
Primary members and Life Members containing names ,address and their occupations,the date of admission and of cessation of membership with reason, the Register will
be kept open for inspection of the members of society on requisition.
All entries required to be made there in shall be entered
within a period of 30 days.
Membership may be electronically collected by onine or offline subscription and data will be preserved
electronically if Executive committee take decision in this regard.
Preservation of hardcopy is the duty of the Executive committee or the duty
will be given by the President for this purpose.
(v) Rights and obligation of members:
Every bonafide member of this society will have
the rights of enjoyment all benefits which will be granted or sanctioned by the
Bangiya Yadav Mahasabha as well as Nadia District
Yadav Sabha if there will have no constraints imposed by the President or
District Executive committee.
* Bonafide member means active
primary or life time member both.
(vi)Expulsion and removal :
If a member has any
involvement against the association or any fault regarding misuse of power or
disobey the direction of the President or any higher authority of this
association he may be removed by the District Executive committee in a meeting
convened for this matter.
If any member
whether he or she is office bearer or primary member or Life member he will be expelled from his /her Membership
by the District Council after careful observation if he or she will be accused by any IPC or
any complaint lodged by the Other member or members of the Society and the
complaint proved as true or any punishment will be given by the Honourable
court in his jurisdiction.
5.Governing Body:
(i). Organisational Structure The
Nadia District Yadav Sabha consists of:
(a)
District unit : (i) The District Executive Committee (ii) The District
Council.
(b) Block/Thana/Town/Municipality
unit : (i) The
Block/Thana/Town Executive Committee
(ii) The Block/Thana/ Town/Municipality
Council.
(c) Primary unit : (i) Primary Committees (Village
committee and ward level committee)
(ii). All cities having municipal corporation
status shall be treated as separate Urban Districts for the purpose of this
Constitution Under the District Nadia.
(iii). A Metropolitan City with more than 15 Lac
Population may be divided into more than one Urban District.
6. Functional Procedure of The
Organisation
(A) Primary level Unit
(i) Village/Town
/ ward Yadav Sabha (minimum 11
members necessary to form a Unit)
(ii) Primary
Members and the Life member of the village/ Town/Ward concerned will elect President of the
Village/Town/Ward committee & elected President will nominate 5 office
bearers to complete the Village /Town/Ward Committee(President,Vice
President,Secretary,Assistant Secretyary
and Treasurer).
(iii) Send
the list of the office bearers & Primary
members list (full name , address and Mobile Number* whats
app number) with Rs. 101/- as
affiliation fee through the Block/ Thana level Unit to District
President.(affiliation will be renewed after every 2 years)
(B) Anchal level unit
(i) Anchal Yadav sabha (Every Gram Panchayet in the Block may form Anchal
Level Yadav Sabha).Presidents of the Village/Town/Ward committee Yadav Sabha will elect the President of the
Anchal Level Yadav Sabha. President will nominate other office bearer for
formation of full committee but the
committee never include more than 15 members,normally
11 members will be preferred.
(ii)
Eligibility for formation : minimum 101 members or 10 Primary level units.
(iii) Anchal
level committee will try to form all the village level committee and minimum 50
percent of village under that Anchal may/ must will have the committee for
affiliation from District. Affiliation fee Rs.101/- and the process is same for
affiliation of other level.Anchal committee President
will send 2(two) Block council member to the Block Council.President
is an ex officio member of the Block executive committee.List
of all office bearer will be send to the District committee through the Block committee.
(C)
Block/Thana level unit .
(i) Block/Thana
Yadav Sabha will be formed after formation of Anchal Committee in that Block
(More than 50% Anchal having Anchal
Committee is the elegibility for formation of Block
Committee.)
(ii)
President of the Anchal Yadav Sabha
committee will elect President of Block /Thana Yadav Sabha & The
Block /Thana Yadav Sabha President nominate 9 to 11 office Bearers and
2(Two)District council member (1DCM/50
Primary members ) .
(iii)
President will Send the list of the office bearers and DCM list to the District
level unit (full name & address with
telephone/mobile *whats app numbers).
(iv)
Block/Thana level Yadav Sabha Executive Committee will be constituted with (a) President And other
office bearers & all the Village /town /ward committee Presidents b) Block
/Thana Council will be constituted with
Executive committee members and district council member of that Block/Thana.
(v) Affiliation fee of Rs.201/- to be send
to the State unit with a list of Block/Thana level Unit’s Executive Committee
members through the District President (affiliation will be renewed 2years).
(D) District level Unit
(i) District/same as district Yadav
Sabha (according to
the constitution).
(ii) All the
President of the Block/ Thana level unit will elect District Yadav Sabha
President & he will nominate 10 to 15 office bearers. Send the list with
full name & address with Rs.501/- as
affiliation per year fee to the State Unit (affiliation will be renewed 2
years).
(iii) District Executive Committee :
Composition.
(a) District office Bearers. (b) All
Presidents of the Block /Thana level units (c) State office bearers from the
district (if any).
(iv) District Council
(I)
(a)
Dist. Executive Committee members .(b) DCM from Block/Thana level unit (1/50
general members).
(II)
Power
: (a) DCM elect 2 State Council members; (b) Assist & direct about the
function of DYS (c) DCM will appoint returning officer at the time of election
of District President.
7. Office Bearers : (A) Composition
President – 1 (One);Vice President – 4(Four);
Secretary – 1(One) ; Assistant Secretary – 4(Four) including office
Secretary(one assistant secretary will be the office secretary); Treasurer – 1
(One); Assistant Treasurer-1 (One).
Only President of all level will be
Elected as per Election Procedure (See Section -20) and all other office bearer
will be Nominated by the President.
(B) Powers & Function of Office
Bearers :
President : (i) As a Head of the Organization
will preside all the Meeting .(ii) President will appoint the Office
Bearers/Members of different “committee(s)”, “Trust(s)”, (iii) President will
appoint the district /Block Yadav Sabha, President /Office Bearers on Ad hoc
basis if there is no elected body (iv) President may dissolve/suspend his
office /Office bearers /Members of different “committee(s)”, “Fund(s)”,
“Trust(s)” any district or Block Yadav Sabha for corruption charge or mis-conduct or
nonfunctioning.
Vice President : In absent of President and Working
President senior vice President will act
as President and conduct the meetings.
Secretary : The Secretary shall
execute all the work and jobs as assigned to him from time to time by the
President, Executive committee in the interest of the Nadia District Yadav
Sabha.
Treasurer : The Treasurer shall be in charge of
the funds of the and Shall keep proper
accounts of all income, expenditure and investments.
Assistant Secretaries : Subject to the general control of
the President, the Assistant Secretaries shall be in charge of the functioning
of the Mahasabha. Out of 3 Assistant Secretaries one shall be designated as
Office Secretary. He Shall be responsible for the preparation and publication
of report of the convention, special convention, the District Council meetings
and the District Executive meetings. He Shall prepare a report of the working
of the including an audited statement of
accounts for the period since the last submission of such report and submit the
same to the meeting of the District
Council to be held at the beginning of each year and have it circulated
to the members well in advance of the meeting. He shall also be the
Assistant Secretary in charge of Sadar Subdivision (Krishnagar) area. Other 2 Asstt.
Secretaries will be designated as in charge of Tehatta
Subdivision Asstt. Secretary and Kalyani and Ranaghat(Both) Asstt. Secretary .
The Asstt.Secretaries will discharge the duties as
may be assigned to them by the President.
The Sadar Subdivision In Charge (Asstt. Secretasry) will be the In
charge of Yadav Keshari – appointed by the President. He
will arrange for the materials for publication & form a
Editorial Board where he will be the Chairman and his duty to submit Written matter to State Committee
of Yadav Keshari and distribution of the Said Journal with a accounts register
of Subscriber.
(C) Criteria for State Council member
of BYM : Must be a
life member of BYM.
(D) The term of all office bearers of a council and
committee shall be two years. If due to some extraordinary circumstances, the
election of the President cannot be conducted within the stipulated period it
can be extended up to the holding of next annual session with the approval of
the executive committee.
8. Area of operation :
(a) The
jurisdiction & operations of the Nadia District Yadav Sabha shall be
confined to the limits of Nadia District
(all Blocks).
(b) Head Quarter of District Yadav Sabha
preferably in the same district H.Q.
9. Qualifications for voters and
Candidates
(a) Every
primary member on the rolls prepared in accordance with these provisions shall
be entitled to vote in the election to the primary Unit.
(b) Only a
person who is continuously a primary member for a period of two years or life
member shall be eligible for election to any Council or executive above the
level of Primary Unit.
(c) No
office bearer shall be eligible for the
third Consecutive term to hold the same
office normally.
(d) Decision of the President or the
District Executive committee in case of dispute regarding voter will be the
final and no one will be the candidate in the election in all level who is not
a voter.
10. Special invitees :-
The District executive and the Executives at the Block/
Thana and lower levels may co-opt up to
10% of the total membership of the District Councils, and other lower councils
concerned. The special invitees are not
entitled to voting right.
11. (A) Flag : The flag of the Mahasabha Shall be
the District Flag which is in navy blue
colour with Lord Krishna having “Sudarshanachakra” in
right hand and conch in his left hand.
(B)
Logo: Lord krishna having “Sudarshanachakra”
in right hand and conch in his left hand.
12. District Convention (District Yadav sabha Session)
(i) The
District Convention shall ordinary be held once in two years at a place
to be decided by the state Executive.
(ii) The District Council shall meet at the “Delegates Committee Conference” under the chairmanship
of the President prior to the District
convention and shall prepare the agenda of work and the draft
resolutions for the District Convention.
(iii) The
Block/ Thana Council in whose
jurisdiction the District Convention is
held ,shall act as the Reception
Committee and may co-opt additional members for the purpose.
(iv) The
Reception Committee shall make all necessary arrangements, including collection
of funds of which separate and full accounts shall be maintained. These
accounts shall be audited by the auditors appointed by the state Executive
within six months of the session.
(v) Surplus
funds and assets shall be divided between the District Council and the Block
/Thana Council equally.
13. Special Session of the Nadia District Yadav Sabha
(i) Special session of the Nadia District Yadav Sabha may be held,
if the District Executive decides or if
a majority of the District Council,
through their resolutions, make a request to the President, to convene such a
special session for discussion of the agenda specified in the resolution.
(ii)
Delegates to the annual session shall be the delegates for the special session.
(iii) Such
session shall be organized by the District Council of the District select for
holding the session.
14. Meeting
1) Annual
General Meeting (AGM): Once in a year. Within 1 & ½ month from 1st
January. Called by the Secretary in consultation with President. Clear one
month notice is essential for AGM.
2) Council
Meeting & Executive Committee Meeting : Three times in a year called by the
Secretary or Assistant Secretary(Office
Secretary )as directed by the President. Clear 15 days’ notice is essential for
those meetings.
3) Office
Bearers Meetings : At least six times in a
year called by th Assistant Secretary ( Office
Secretary )in consultation with the President.
4) Emergency
Meetings : If necessary within 24 hours’ notice by Secretary / Office Secretary
/Any one Assistant Secretary as directed by the
President.
15. Quorum of the Meeting
1) 15% of the
Executive Committee Member/Council Meeting, present at the respective meeting
Shall form the quorum.
2) If within
one hour from the time appointed for the meeting, the quorum is not present,
the meeting may be postponed or adjourned as decided by the President. At such
adjourned meeting whatever the number of members present shall form the quorum.
16. Vacancies
All vacancies caused by resignation,
removal or death shall, unless otherwise provided for be filled in the same
manner in which the previous incumbent was elected and persons so elected,
shall hold office for the unexpired term or can be filled up by resolution
passed by the Executive Council with not less than a 2/3 majority.
17. Change in the Constitution
(A) The
Constitution of the Nadia District Yadav Sabha can be amended or altered only in the
annual session (AGM) of the Nadia District Yadav Sabha Council with the recommendation by the District Executive Committee , by a majority of not
less than 2/3rd voters present and voting.
(B) Nadia
District Yadav Sabha will amend their
rules according to the direction of BYM after ratification by the Registrar of Societies of W.B.
18. Notwithstanding anything contained in
this constitution and the rules will apply to the District/Block/Thana
/Town/Municipality/ Ward/Anchal/Village level “Yadav Sabhas”.
19. Block/Thana/Town/Municipality/ Ward/Anchal/Village
level “Yadav Sabhas” have the full right to registered their society under
society Registration Act 1961 with due permission by the Nadia District Yadav
Sabha who will consult with the BYM President for that permission.
20. Election procedure :
(i) (a) The
election of President for the primary unit shall be conducted in the special
meeting called for the purpose by the election officer .
(b) The membership register should be closed
before one week of the election meeting and the valid membership list should be
prepared and handed over to the Returning Officer appointed by District
executive committee.
(c) Members
present at the election meeting can propose name for the
President and if there is a contest, vote by ballot can be arranged and after
counting the candidate who got the highest number of votes should be declared
elected by the Returning Officer.
(ii) The
election of President for the Block /
Thana Unit, Shall be conducted in the same manner as prescribed in
constitution.
(iii) The
election of President for the Block/Thana
Unit, District Unit shall be
conducted by a secret ballot by adopting a time schedule for the poll
arrangement as is being done in the case of normal election.
The ballot
shall be sent to the voters (District Council members) by record delivery
/certificate of post and the same shall be returned by the voter after giving
their vote to the Returning officer by the same method.
(iv)
Preparation of voter list in all level will be the responsibility of the
Assistant Secretary designated as Office secretary,he
after consultation with District President he will start the process and
decision of the District president is final in this regard.Any
one who failed to renew his Primary membership in time before December
of that year he will not be a Voter for
the election which will be executed in the month after December .It is
mandatory in the year is fixed for election the election for election of the
President must /may be within January to 10 th April
of the year next.To complete the State election
District will complete the election before 31st March but after30 th November of
previous year of the year fixed for
state election.
(v) The Voter list will contain for (a) Village /Ward level election for
President : All the valid primary Members and life members of that Village
enlisted in the District committee for that Block /Anchal . (b) Anchal
/Municipality level Election for Anchal /Municipality President : only the
Village /Ward Committee Pesidents and all Presidents
of the cell exist before that election and approved by the District Executive Committee.No unapproved President will caste his/her vote
.(c) Block /Thana level Election for Block/ Thana President : Only the approved
Anchal /Municipality President of that Block /Thana and all Presidents of Cell
exist on that Anchal/ Municipality and approved by the District executive
committee.(d) District Level Election
for District President: Only approved block /thana President and all
Presidents of Cell exist on that Block /thana and approved by the District
executive committee.(e)Only life members are eligible for contesting in
election for the President Post in all level except Village or ward level if
there have no life member and in this case the Primary member having continuous two years membership will be eligible,if there have any Life member he or she will have
the first priority for contesting in the election.(f) Election will be
completed before the expiry of the existing committee and the process of
election will be started before 60 days of expiry by the President in all level
of Yadav Sabha.
21. Formation of ad-hoc committees at
the Block/Thana /Town/Ward/Village
level:
On the failure of a Block/ Thana Unit or any other Lower Units thereof or for
not to functioning in terms of the Constitution in accordance with the
directions of the Superior Committee the latter may suspend the existing
committee and form an ad -hoc committee to carry on the work of the Mahasabha /
cocern level Yadav Sabha in the area. An ad-hoc
committee so constituted shall ordinarily function for a period of 6 (six )months provided that the period
can be extended up to a total period of one year. Unless otherwise specified an
ad-hoc committee shall enjoy the same power and privileges as of a normal committee.In no cases the Ad-hoc committee will continue
its tenure more than one year with prior approval of the District Executive
Committee.
22. Functioning of
cells at District and Block/ Thana
/Anchal/Town/Municipality/ Ward/ Village
levels
The District Units and Block/ Thana /Anchal/Town/Municipality/ Ward/ Village level unit
shall constitute the following cells consisting of not more than 5 (Five) members out of whom 1(One) may be the Convener : (a) Women Cell (b) Youth Cell,(c) Cultural Cell (d) Intellectual Cell, (e) Sports Cell ,(f)Milk and Curd business cell.The number of cell may be increased with prior approval of the District Executive Committee.
23. Opening of Bank Accounts
Bank account should be opened in the name of the Nadia District Yadav Sabha with a Nationalized Bank / Schedule Bank situated at the headquarters of the Unit and shall be operated jointly by the President / Secretary and the Treasurer. Except President’s signature and seal no transaction will be valid transaction.
24. Landed
property
The Nadia District Yadav Sabha shall acquire and own landed property.In case of any property fully financed by the Bangiya Yadav Mahasabha that property will be the property of the Bangiya Yadav Mahasabha with the consultation of District executive committee, for any dispute decision of the State committee will be final.
25. Dissolution:
The association shall not be dissolved by any General Body meeting of the Nadia District Council under any circumstances. Its properties ,assets in any form or shape –whether in cash or kind , shall not be disposed of in any manner.
OR
The Association(Nadia District Yadav Sabha ) may be dissolved by passing a resolution in a Special meeting convened by the President with prior information to the President of Bangiya Yadav Maha Sabha with a request to present himself or sending a Representative for this specific purpose and if two-third majority of members (District Council ) vote for dissolved the Association, the Association shall stand dissolved in Presence of the Representative of Bangiya Yadav Maha Sabha .In the eventuality of Dissolution of the Association ,its properties ,assets in any form or shape –whether in cash (Bank accounts or in hand) or kind ,shall be donated to the State Assocition that is to Bangiya Yadav Maha Sabha.
